Activity Waiver Form- NDOORZ LTD

IN CONSIDERATION of being allowed to participate in the Activity and other good and valuable consideration, the receipt of which is hereby acknowledged, the "Participant" or Participants Parent/Guardian or Private booking contact, agree with NDOORZ LTD, trading from Unit 38, Winnington Business Park, Northwich CW8 4DL and their associated coaches who run the Activity (the "Activity Provider") to the following:

1. DETAILS OF ACTIVITY

The Participant(s) will be participating in any the following activity: 

1. Football coaching session (the "Activity") provided by the Activity Provider and/or the associated coaches.
2. Private hire of the facility – in this case the person booking the ‘The Activity’ is responsible ensuring ALL Participants are aware and have accepted this waiver and they hold the responsibility of making sure any issues, medical condition will be shared with the Activity Provider prior to taking part on the ‘Activity’
3. Birthday Parties.
4. CONSIDERATION
5. Being of lawful age (as specified for each Activity) and in consideration of being permitted to participate in the Activity, the Participant releases and forever discharges NDOORZ LTD, the Activity Provider, its owners, directors, officers, employees, agents, assigns, legal representatives, and successors from all manner of actions, causes of action, debts, accounts, bonds, contracts, claims, and demands for or by reason of any injury to person or property, including injury resulting in the death of the Participant, which has been or may be sustained as a consequence of the Participant's participation in the Activity, except for personal injuries resulting from the negligence of the Activity Provider.

1. The Participant understands that the Participant would not be permitted to participate in the Activity unless the Participant signed this Waiver.
2. CONCURRENT RELEASE
3. The Participant acknowledges that this Waiver is given with the express intention of effecting the extinguishment of certain obligations owed to the Participant by the Activity Provider, and with the intention of binding the Participant's spouse, heirs, executors, administrators, legal representatives, and assigns.

1. FITNESS AND CONDITIONS TO PARTICIPATE
2. The Participant acknowledges to the Activity Provider that the Participant does not have any physical limitations, medical ailments, or physical or mental disabilities that would limit or prevent the Participant from participating in the Activity. If required, the Participant will obtain a medical examination and clearance. If the Participant has any medical conditions that the Activity Provider should be aware it is their responsibility to inform the Activity Provider of them prior to the session.

1. For Participant's and others wellbeing, if in Activity Providers opinion the Participant is physically or mentally unfit to participate in the Activity then the Activity Provider has absolute discretion to reserve the right to refuse entry or participation.

5. APPROVED FOOTWEAR

1.    Each Participant will be required to have appropriate and approved footwear to take part in the Activity. Footwear worn for the duration of the activity MUST be clean football boots with plastic moulded studs. NO normal sports trainers can used during the activity on the pitch.

2.   Each participant to all football sessions are also required to wear shin pads.

1. Incorrect footwear or lack of shin pads will result in refused entry with no refunds given for the session booked.
2. If you are planning to use the facility for any activity that may not normally use football boots please contact us before booking on info@ndoorz.co.uk to check suitability

1. PHOTOGRAPHY AND VIDEO

The Activity Provider will, from time to time, take photos and video during “the Activity”, that may be used in marketing activities and in social media. If you do NOT wish your or your child’s images to be used please inform us of this by ticking the relevant consent box as part of the booking system and ensure you or your child wears a red wristband (provided by ndoorz) during their Activity. If a red wristband is not worn then the Activity Provider cannot be held responsible if you or your child’s image is used in marketing or social media channels.

7.   FULL AND FINAL SETTLEMENT

The Participant acknowledges and agrees with the Activity Provider that: (1) the Activity Provider has given the Participant sufficient time to carefully read this Waiver, (2) the Participant has been given the opportunity and has been encouraged to seek independent legal advice prior to signing this Waiver, (3) the Participant fully understands the risks and claims that the Participant is waiving to participate in the Activity, (4) the Participant is freely and voluntarily executing this Waiver, and (5) the Participant is forever prevented from suing or otherwise claiming against the Activity Provider for any property loss or personal injury that the Participant may sustain while participating in or preparing for the Activity, except for any personal injury arising from the negligence of the Activity Provider.

1. GOVERNING LAW

This Waiver will be governed by and construed in accordance with the laws of the Country of England.
